Pharmaceutical manufacturer Indivior Inc. has agreed to pay $385 million to settle lawsuits in the U.S. related to its opioid addiction treatment, Suboxone.

These lawsuits were brought by drug wholesalers who claimed that Indivior unlawfully suppressed generic competition for Suboxone, bringing an end to a protracted legal battle.

This settlement follows previous agreements, including a $102.5 million settlement with U.S. states and a $30 million settlement with health plans.

The trial on the wholesalers’ claims, scheduled for October 30, has now been canceled.

The settlement is pending approval from the U.S. District Court for the Eastern District of Pennsylvania, with payment expected next month.

Suboxone, approved in 2002, had exclusive rights until 2009, but the lawsuit alleged that Indivior switched to an oral film version to maintain its monopoly as generic alternatives emerged.

In 2020, the company also settled with the U.S. government for $600 million over allegations of fraudulent promotion.

Opioid-related deaths have been a significant issue in the United States, with over 900,000 deaths since 1999, according to the CDC.

Suboxone has been embroiled in legal disputes for years, including a $300 million settlement in 2021 over allegations of false marketing that led to misuse of state Medicaid funds.

This latest settlement will be paid out over seven years, and Indivior’s overdose reversal spray, Opvee, received approval in May.

Additionally, there will be a $228 million charge in the third quarter (excluded from adjusted earnings).

Consequently, the upcoming trial scheduled for October 30 has been canceled.

CEO Mark Crossley expressed satisfaction with the settlement, stating that it concludes a long-standing antitrust matter, providing greater certainty for Indivior stakeholders.

This resolution allows the company to continue its focus on assisting patients with opioid use disorder and mental health issues worldwide.

Reckitt Benckiser, the parent company, had previously agreed to pay $1.4 billion to the federal government in 2019 to resolve potential criminal and civil liability involving its Suboxone business.

Multiple attorneys general from various states were involved in this settlement.

Illinois is expected to receive approximately $2.9 million from the settlement.

As part of the settlement, Indivior is obligated to provide specific information to the states to prevent similar conduct in the future.

This includes sharing all citizen petitions submitted to the U.S. Food and Drug Administration (FDA), notifying the states about new products they plan to launch, and informing them of any proposed mergers or acquisitions.

Additionally, in 2021, Attorney General Raoul and a coalition of state attorneys general reached a $300 million national settlement with Indivior to resolve a separate lawsuit.

The lawsuit, which began in 2016, alleged that Indivior switched from a tablet version of Suboxone to an oral film version to extend its monopoly, preventing generic manufacturers from offering lower-cost tablets.

The settlement, which includes additional disclosures to prevent anticompetitive practices, awaits approval from a federal judge in Philadelphia, who oversees nationwide antitrust litigation related to Suboxone.

Indivior plans to pay the settlement in cash this month, having set aside $290 million last year for potential litigation costs.
